What is the Electronic Health Information Export Requirement?

The 21st Century CURES updates to 2015 Certified EHR Technology (CEHRT) update requires criteria § 170.315 (b)(10) Electronic Health Information Export to be met in 2023 by Health IT. The requirement states that all certified Health IT must be able to export Electronic Health Information (including payment data, imaging, and any data stored in the module at time of export) for both a single patient, as requested by the patient, and the patient population, as requested by the provider. 

To fulfill this requirement for both the single patient and patient population exports, the data must be exported electronically and in a computable format by Elation within a reasonable request of time. This Help Center Article will act as the publicly accessible hyperlink of the export’s format that must be included in the export file as outlined by the criteria.


 

How Elation will help you stay compliant

To export EHI data for a single patient:
  1. Open the patient’s chart in Elation.
  2. Click the “More” button in the navigation bar and then click “Data Exchange”.
  3. Click “Export Entire Health Information (EHI)” .
  4. Afterwards click “Export Patient EHI” in the confirmation box.
  5. You will receive two emails at the email listed in the confirmation box. The emails will have the subject line ‘ACTION REQUIRED: Elation Data Export’. One email will contain a download link for the export and the other email will contain the password to unlock the file after you download it. You will have 6 days to download the file before the download link expires.
    • You can optionally choose to email a copy of the export to the patient by checking off the “Also share with patient” box. We recommend verifying the patient’s email address before sending them the export.
 
Important Note: In order to export EHI for individual patients, you must have Admin level privileges. To become an Admin, you must ask an existing Admin level user in your practice (most likely a primary provider level account holder) to grant you privileges via the Manage Accounts Settings page.


Providers can also request that Elation completes an EHI export for their entire patient panel at their request. Additional Regulatory Information

Elation Health facilitates Customers’ ability to comply with information disclosure obligations in its exporting of electronic patient health information. It is the Customer’s responsibility to understand applicable laws, rules and regulations applicable to its practice and to comply.  By default, the Elation Health EHI does not include information identified as “Confidential Notes” (defined below) in exports.  It is Customer’s responsibility to ensure that psychotherapy notes as defined in 45 CFR 164.501, information compiled in reasonable anticipation of, or for use in, a civil, criminal, or administrative action or proceeding, or data regarding a person who has been deceased for more than 50 years or other information that may not subject to disclosure are included in these Confidential Notes areas of the EHI. In accordance to the EHI Export certification criterion, all electronic patient information will be exported, except for the following subsets of data:

Confidential Notes Features: 
  • Files in Elation that can be tagged as ‘Keep this Confidential’ (e.g., orders and visit notes) or ‘Mark Confidential’ (e.g., reports)
  • Free text in the ‘Notes and Chart Management’ section in the Demographic Dialog
  • Free text in the ‘Notes’ section of our Elation Billing product

For single patient exports requested by the patient, Confidential Notes will always be withheld.* For bulk exports requested by a provider or practice, users will have the option to include or exclude Confidential Notes.

*Additional information: In alignment with the HIPAA Privacy Rule, it is the provider’s responsibility to include any information that would otherwise be disclosable to a patient under applicable state and federal healthcare laws. For single export requests by a patient where the Confidential Notes are requested, please reach out to Elation Support to fulfill this request. Confidential Notes features are intended to help providers restrict access to information that qualifies for an information blocking exception under applicable law; however it is the provider’s responsibility to ensure its compliance with applicable laws, rules and regulations related to information disclosure.

 

Elation’s Designated Record Set

In accordance with the Electronic Health Information Export criteria, Elation must provide information about the export format to facilitate the interpretation of the electronic health information. The Elation Health Designated Record Set contains the electronic health information available in a patient's Elation Health record in a computable, pdf, xml, or image file format. Some electronic health information might not be available in an xml or pdf format, such as rich text documents or images. This information might be referenced from the EHI Tables, but the actual files can be reviewed in a separate download in the export. Information may not be available based on the configuration of modules from Elation Health the practice, provider, or integrations in use. 

The content included in the export might vary based on a variety of factors, including:
  • The software applications in use at the practice or provider that generated the files.
  • The documentation and software use practices in place at the practice or provider  that generated the files.
  • Configuration decisions made by the practice or provider that generated the files.
  • The practice or provider includes materials not sourced from Elation Health.
 

Data

The data elements listed in Elation's Designated Record Set are the identified data elements in Elation’s system which store EHI. The formats of data exported are associated with the relative datum.

Frequently Asked Questions (FAQs)

My practice has multiple instances on Elation. Will I receive a separate export for each instance?

At this time, Elation does not support cohorting or filtering of patient data to fulfill this requirement. The § 170.315 (b)(10) Electronic Health Information Export criteria states that filtering and the ability to create subsets are not required for certification.
